REBA Files Brief in Federal Court Unauthorized Practice of Law Litigation

Responding to the defendant’s motion for summary judgment, REBA has filed a counter motion with a comprehensive 30-plus page memorandum of law seeking a declaratory judgment in favor of the Association.

“The filing of this brief, with supporting materials, is a defining moment in our nearly 20-year effort to stop non-lawyer real estate closings here in Massachusetts,” said Jon Davis, longtime chair of the Association’s Practice of Law by Non-Lawyers Committee. “Every REBA member—and anyone interested in this issue—should read this brief,” he said. “It is a comprehensive –and ultimately decisive—statement of this vital issue.”

The name of the case is The Real Estate Bar Association for Massachusetts, Inc. vs National Real Estate Information Services, Inc. and National Real Estate Information Services, L.P. The case has been filed in the United States District Court for the District of Massachusetts as Docket C.A. 07-10224-JLT.
